Surgery and the Army?

I just had my gallbladder removed and before my surgery was done my husband contacted his chain of command and was told as long as I have a surgeons note saying I need my husband to be home to help with the care of our child while I was recovering he would have that time off to care for us. Now it is after my surgery and his Sargent is refusing him to be released. Can he do this? Do soldiers not follow FMLA? Who can I talk to about this considering I am left at home with a baby I can't pick up or take care of. It has been 4 days since my surgery and I could injure myself if I were to do what they are requiring me to do without him here. Thanks
